 Welcome to Mantra Beats LLC (“the App,” “the Website,” “the Social Media Platforms,” and “the Online Store”). By accessing or using any of these services, you agree to comply with the terms and conditions outlined in this legally binding Terms of Use, Conditions & Privacy Policy (“Agreement”). If you do not agree, you must discontinue use immediately. 

1. ACCEPTANCE OF TERMS
       This Agreement is a legally binding contract between you and Mantra Beats LLC, a California Limited Liability Company (LLC). By using the App, Website, Online Store, or Social Media Platforms, you affirm that you are at least 18 years old or have the legal capacity to enter into this Agreement. If you are under 18, you may only use these services with the involvement of a parent or guardian.
2. DESCRIPTION  OF SERVICE
       Mantra Beats LLC is a meditation and rhythmic sound immersion app designed to support relaxation, mindfulness, and personal well-being through customizable sound experiences. The app allows users to integrate binaural beats, music beats, soundscapes, and personalized mantras, whether recorded, text-based, or preset audio files.
       • Voice Recording and Text-Based Affirmations/Mantras
       • Listening to curated Binaural Beats, Music Beats, and Soundscapes
       • Mixing Audio Files for an immersive experience
       • Access to Original Music Beats, Soundscapes, and Preset Mantras
       • Guided Self-Reflection/Mantra Practices
3. HEALTH AND SAFETY DISCLAIMER
       Mantra Beats LLC is designed for meditation, relaxation, and personal wellness. It is not a substitute for medical, psychological, or therapeutic treatment. It is not intended to diagnose, treat, cure, or prevent any medical condition.
       • If you have medical conditions such as epilepsy, tinnitus, neurological disorders, or mental health concerns, consult a healthcare provider before using the App, Website, Online Store, or Social Media Platforms.
       • Mantra Beats LLC disclaims any liability for adverse effects resulting from use or misuse of the App, Website, Online Store, or Social Media Platforms.
       • These services are not designed for emergencies. If you experience distress, anxiety, or require urgent assistance, seek immediate professional help.
       • Use the App at a comfortable volume level to prevent hearing damage.
       • Do not use the App while driving, operating machinery, or in any situation where alertness is required.
       • Discontinue use immediately if you experience discomfort, dizziness, or adverse 

            effects.

        4. USER CONDUCT
    You agree to use the App, Website, Online Store, and Social Media Platforms only for lawful purposes and in accordance with these Terms. You are responsible for:
✔ Maintaining the confidentiality of your account information.
✔ All activities that occur under your account.
✔ Ensuring that your use of the App does not violate any applicable laws or regulations.

        5. RESPONSIBLE USE GUIDELINES
    To ensure a safe experience, you agree to:
✔ Not use the App while driving, operating machinery, or in any situation where alertness is required.
✔ Adjust audio settings to a comfortable level to prevent hearing damage.
✔ Discontinue use immediately if you experience discomfort, dizziness, or adverse effects.
✔ Consult with a healthcare provider before using the App, the Website, Online Store, and Social Media Platforms affiliated with the App.

       6. ACCESSIBILITY  & ADA COMPLIANCE
    We strive to make Mantra Beats accessible to all users. If you have a disability and require assistance, please contact [contact@mantrabeats.com]. However, we do not guarantee full compliance with accessibility laws, and  use of the app is at your own discretion.

      7. CHILDREN'S PRIVACY (COPPA COMPLIANCE)
    Mantra Beats LLC does not knowingly collect or solicit personal information from children under the age of 13. If we learn that we have collected personal information from a child under age 13 without verified parental consent, we will delete that information as quickly as possible.

     8. THIRD-PARTY SERVICES
    The App and Website may link to or interact with third-party platforms such as Apple, Google Play, PayPal, Shopify, or social media platforms. Mantra Beats LLC is not responsible for the content, services, policies, or practices of any third-party services. You agree to be bound by the terms and policies of any third-party service used in connection with our platform.

     9. DATA COLLECTION & PRIVACY RIGHTS (GDPR/CCPA)
    We may collect limited usage data such as app performance metrics or crash reports. We do not sell personal data. If we implement additional data collection or storage in the future (e.g., through cloud services), users will be notified and given an opportunity to consent or opt out.
    • If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA), including the right to know what data we collect, request deletion, and opt out of data sales.
    • If you are located in the EU or UK, you have rights under the General Data Protection Regulation (GDPR), including the right to access, correct, or delete your data.

     10. USER-GENERATED CONTENT & LICENSE
    By uploading, recording, or submitting content to the App, you retain ownership of your original content. However, you grant Mantra Beats LLC a non-exclusive, worldwide, royalty-free license to store, transmit, and display your content solely for the purpose of operating and improving the App.
    You represent that you have all necessary rights to upload any such content and that it does not infringe on third-party rights.

     11. INTELLECTUAL PROPERTY RIGHTS
✔ All content within the App, including text, logos, images, music, and software, is the exclusive property of Mantra Beats LLC.
✔ Unauthorized copying, distribution, or modification is prohibited.
• You may not reproduce, modify, distribute, sell, or create derivative works without permission.
• Unauthorized use may result in legal action.

     12. SUBSCRIPTIONS  & PAYMENTS
    Mantra Beats offers the following subscription plans:
    • $0.99 per month (billed monthly)
    • $9.99 per year (billed annually)

     13. Auto-Renewal & Cancellation
• Subscriptions automatically renew unless canceled at least 24 hours before the renewal date.
• You can manage or cancel your subscription through your Apple or Google Play account settings.
• No refunds or prorated refunds will be issued for partial use of a subscription period.

     14. Chargeback Fraud Protection
          Falsely disputing a legitimate payment (chargeback fraud) is prohibited. Users engaging in      fraudulent activity may have their accounts terminated.

     15. DATA RETENTION & DELETION POLICY
    Users may request data deletion by contacting contact@mantrabeats.com. We will delete user data upon a verified request within 30 days, except where required by law. Currently, Mantra Beats LLC does not store user data on a cloud server. In the future, we may introduce cloud storage options to enhance user experience. If and when cloud storage is implemented, users will have the right to request deletion of their stored data. However, deletion requests will be processed in compliance with applicable privacy laws.

     16. E-COMMERCE & PRODUCT SALES TERMS
    • All purchases of Mantra Beats LLC products and merchandise are final unless otherwise       specified in our refund policy.
    • Prices and availability of products are subject to change without notice.
    • We reserve the right to refuse or cancel any order for any reason.

     17.  SHIPPING  & DELIVERY POLICY
    • Shipping times and fees will be displayed at checkout.
    • We are not responsible for delays caused by shipping carriers or incorrect addresses provided by the customer.

     18.  PAYMENT & REFUND POLICY
    • Payments must be made through accepted methods listed at checkout.
    • Refund eligibility is determined by our Return & Exchange Policy (see below).
    • Unauthorized chargebacks or disputes may result in account suspension.

     19. FORCE MAJEURE
    We are not responsible for delays or failures due to events beyond our control, such as cyberattacks, natural disasters, or internet outages.

     20. PSYCHOLOGICAL HARM WAIVER
    Users acknowledge that deep meditation or brain entrainment may bring up emotional experiences. We are not responsible for any psychological effects arising from the use of Mantra Beats LLC.

     21. NO AI MANIPULATION/INFLUENCE CLAUSE
    Any AI-generated content within Mantra Beats LLC is for entertainment and meditation purposes only. We do not use AI to influence personal decisions or provide medical advice.

     22. LIMITATION OF LIABILITY
    To the fullest extent permitted by law, Mantra Beats LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues arising from your use of the App, Website, Online Store, or Social Media Platforms. In no event shall      our total liability exceed the amount you paid to us, if any, in the past twelve months.

     23. ENTIRE AGREEMENT & SEVERABILITY
     This Agreement constitutes the entire agreement between you and Mantra Beats LLC. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

     24. DISPUTE RESOLUTION & ARBITRATION AGREEMENT
     This Agreement is governed by the laws of California. Any dispute, claim, or controversy shall be resolved exclusively through binding arbitration in Los Angeles, California, under the rules of the American Arbitration Association (AAA) and conducted by a single neutral arbitrator.
✔ Class Action Waiver: Users waive their right to participate in any class-action lawsuit against Mantra Beats LLC.
✔ No Jury Trial Waiver: Users waive their right to request a jury trial in any dispute arising from or related to use of the Mantra Beats App, Website, Online Store, or Social Media Platforms.
✔ Arbitration Cost Shifting: If a user initiates arbitration and does not prevail, they shall be responsible for all arbitration costs.
✔ Statute of Limitations: Any claim must be brought within one (1) year, or it is permanently barred.
✔ Governing Law: This Agreement shall be governed by California law.

    25. COOKIES & TRACKING TECHNOLOGIES
    Our Website may use cookies and similar technologies to improve user experience, analyze traffic, and provide relevant marketing. You can manage cookie preferences through your browser settings.

    26. CHANGES TO TERMS & FUTURE MODIFICATIONS
    We reserve the right to modify these Terms at any time. We will notify users by updating the Last Updated date at the top of this page. We may update, modify, or discontinue certain features, content, or functionalities within the App, Website, Online Store, or Social Media      Platforms at our sole discretion. Continued use after modifications constitutes acceptance of the revised terms.
